1. Eligibility and Authority
You must be at least 13 years old and able to provide valid consent under the law that applies to you. If you are under the age of majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian. If you use the Service for an organization, you represent that you have authority to bind that organization to these Terms.
The Service is not directed to children under 13.
2. Accounts and Account Security
Some features require an InkDub account. You may create an account using an email address and password or a supported third-party sign-in method, including Google Sign-In or Sign in with Apple where available.
You agree to:
- provide accurate, current information;
- keep your credentials and devices secure;
- promptly notify us at info@apexforge.tech if you suspect unauthorized access; and
- accept responsibility for activity performed through your account, except to the extent caused by our breach of these Terms or applicable law.
You may not transfer, sell, rent, or share an account in a way that defeats plan, purchase, or device limits. We may require account or purchase verification to protect the Service and other users.
To request account deletion, email info@apexforge.tech from the email address associated with your account using the subject line “InkDub Account Deletion.” Deleting your account does not cancel an active App Store or Google Play subscription; you must cancel it through the applicable store.
3. The InkDub Service
InkDub is an offline-first document reader and narration application. Depending on your platform, device, account, and plan, the Service may include:
- importing and reading supported document formats, including PDF and EPUB;
- on-device text extraction, library organization, duplicate detection, covers, and metadata;
- local system text-to-speech and metered cloud text-to-speech voices;
- background playback, speed controls, sleep timer, synchronized text highlighting, and playback progress;
- locally stored bookmarks, notes, reading statistics, achievements, and preferences;
- chapter audio caching and paid-tier offline audio downloads;
- browsing and downloading eligible books from third-party catalogues such as Project Gutenberg;
- account authentication, purchase restoration, subscriptions, usage allowances, and optional credit packs; and
- advertising on the free tier.
Features vary by platform and may change over time. Some formats, voices, languages, or features may not be available on every device. Cloud narration, catalogue browsing, purchase verification, and account services require an internet connection.
4. Local and Cloud Processing
Imported documents, extracted text, progress, bookmarks, notes, and settings are ordinarily stored on your device. You are responsible for device backups and for maintaining enough storage space.
When you choose a cloud voice or request cloud generation or an offline download, the selected text segment or chapter and synthesis settings are transmitted to our cloud infrastructure and narration providers. Generated audio and timing information may be stored in a private content-addressed cache and reused when an identical text, voice, speed, and processing version is requested. On-device voices do not send document text to us for narration.
Do not submit confidential, regulated, or highly sensitive content to a cloud voice unless you have authority to do so and accept the cloud processing described in the Privacy Policy.
5. Your Documents and Other Content
As between you and InkDub, you retain your rights in documents, text, notes, and other content you import or submit ("User Content"). We do not claim ownership of your User Content.
You grant Apex Forge and its service providers a limited, non-exclusive, worldwide license to host, copy, transmit, process, cache, and create narration from User Content only as reasonably necessary to provide, secure, support, and improve the operation of the features you request. This license ends when the relevant processing and retention periods described in the Privacy Policy end.
You represent and warrant that:
- you own the User Content or have all permissions needed to use and process it through the Service;
- your use of the Service and User Content does not infringe copyright, privacy, publicity, contractual, or other rights; and
- you will comply with any restrictions that apply to content obtained from a library, publisher, employer, school, catalogue, or other third party.
InkDub does not monitor the contents of your locally stored library. You are solely responsible for determining whether you may copy, download, convert, or listen to particular content.
6. Acceptable Use
You must not use the Service to:
- violate any law or another person's intellectual-property, privacy, publicity, confidentiality, or contractual rights;
- generate or distribute unlawful, fraudulent, deceptive, defamatory, abusive, or exploitative material;
- impersonate another person or misrepresent the source of synthetic audio;
- introduce malware, harmful code, or content intended to disrupt the Service;
- probe, attack, overload, or circumvent authentication, security, rate limits, usage metering, subscription gates, device limits, or purchase verification;
- use automated means to scrape the Service, enumerate private caches, or make abusive requests;
- extract, clone, or misuse voice models or provider services except through intended InkDub features;
- resell or provide unauthorized access to the Service, cloud voices, or credits; or
- reverse engineer or modify the Service except as expressly permitted by applicable law or an applicable open-source license.
Cloud narration providers and catalogue operators may impose additional acceptable-use rules. We may block a request or suspend access when reasonably necessary to comply with those rules, protect the Service, or prevent harm.
7. Plans, Allowances, and Offline Downloads
InkDub may offer a free tier, paid Standard and Premium subscriptions, and one-time Studio voice credit packs. Current features, prices, billing periods, taxes, voice availability, and allowances are shown in the App or applicable store before purchase.
All cloud-voice tiers are subject to the displayed usage allowances and service controls. No InkDub tier is unlimited. Cloud narration is measured using generated audio duration or a reasonable estimate that is later adjusted when actual duration becomes available.
The following rules apply unless the purchase screen states otherwise:
- subscription allowances reset on the account's applicable service period and do not roll over;
- one-time Studio voice credits may roll over as described at purchase;
- playback, pre-generation, and offline downloads draw from the same applicable cloud-voice allowance;
- a chapter that has already been charged under the same content, voice, speed, and processing version may be replayed or downloaded again without a duplicate allowance charge;
- changing narration inputs or processing versions may require new generation and a new allowance charge;
- paid offline downloads use one selected voice per book and remain subject to device storage, App compatibility, and entitlement checks; and
- exhausted allowances may pause or prevent cloud generation until the allowance resets, a qualifying plan becomes active, or eligible credits are added. On-device voices may remain available as a fallback.
Fair-use, security, queue, rate, and device controls may delay cloud generation even when an allowance remains. These controls are intended to protect availability and prevent abuse, not to create an additional purchased entitlement.
8. Purchases, Auto-Renewal, Cancellation, and Refunds
Purchases are processed by Google Play or Apple through your store account. The price and currency shown by the store at checkout control. Taxes and store charges may apply.
Subscriptions
Unless identified as non-renewing, a subscription automatically renews for the selected billing period until cancelled. Your store account is charged according to the terms displayed at purchase. If a trial or promotional offer is available, its eligibility, length, price after the offer, and cancellation deadline will be shown before you subscribe.
You can manage or cancel a subscription through the subscription settings for the store account used to purchase it. Cancellation normally takes effect at the end of the current paid period unless the store or applicable law provides otherwise. Uninstalling InkDub, ceasing use, or deleting an InkDub account does not cancel the store subscription.
You may restore eligible purchases through the App. Restored access depends on successful store and server verification and on use of the InkDub account to which the purchase is validly linked.
One-time credit packs
Eligible Studio voice credit packs are consumable purchases. After verification, the stated amount is credited to the applicable InkDub account. Credits have no cash value, cannot be transferred between accounts, and are not a bank account or stored-value facility. Except where required by law or store policy, used credits are not refundable.
Refunds
Refund requests are handled under the rules of the store through which the purchase was made and applicable consumer law. We do not limit any mandatory refund, cancellation, or withdrawal right that applies to you. Contact info@apexforge.tech if you need reasonable assistance identifying or troubleshooting a purchase.
Price or plan changes
We may change plans, allowances, features, or prices for legitimate business, legal, security, provider-cost, or technical reasons. Store-required notice and consent rules apply to subscription price increases. Changes do not retroactively alter a completed purchase except where permitted by the store and applicable law.
9. Third-Party Services and Content
The Service relies on third parties, including Supabase, Google, Apple, Replicate, Modal, Async, Sentry, device TTS engines, and third-party book catalogues. Their services may be governed by separate terms and privacy policies.
Catalogue listings, book files, metadata, and external links are provided by third parties. We do not control or guarantee their legality, accuracy, availability, accessibility, security, or suitability. You are responsible for complying with the catalogue's terms and confirming that you may download and use a title in your location.
InkDub is not sponsored or endorsed by Google, Apple, Project Gutenberg, or any cloud provider unless expressly stated.
10. InkDub Intellectual Property
The Service, including its design, branding, compiled application, documentation, and original software, is owned by Apex Forge or its licensors and is protected by intellectual-property laws. Third-party and open-source components remain subject to their respective licenses.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to install and use the Service for personal or internal business purposes through supported platforms. No other rights are granted by implication.
To report an intellectual-property concern, email info@apexforge.tech with sufficient information for us to understand and evaluate the request.
11. Privacy
The InkDub Privacy Policy explains how information is handled when you use the Service, including local storage, cloud narration, generated-audio caching, advertising, diagnostics, accounts, purchases, and deletion requests. The Privacy Policy is incorporated into these Terms by reference for notice purposes.
12. Service Availability and Changes
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation. Cloud providers, app stores, catalogue operators, operating systems, networks, and device capabilities are outside our control and may affect availability.
We may add, modify, suspend, or discontinue features; change supported formats or providers; release required updates; or impose reasonable security and usage controls. Where a change materially affects a paid subscription, we will provide notice or remedies required by the applicable store or law.
You are responsible for installing updates needed for security, compatibility, and continued access. We are not responsible for loss of local data caused by device failure, insufficient storage, operating-system action, failure to maintain backups, or uninstalling the App.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Apex Forge disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation.
We do not warrant that:
- document extraction, chapter detection, metadata, narration, pronunciation, word timing, highlighting, or generated audio will be complete or accurate;
- every document, language, voice, device, or third-party service will be supported;
- cloud generation or downloads will always be available or complete within a particular time; or
- the Service is appropriate for safety-critical, medical, legal, accessibility-compliance, or other high-risk use without independent review.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
14. Limitation of Liability
To the maximum extent permitted by law, Apex Forge and its directors, officers, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, opportunities, or data, arising from or related to the Service.
To the maximum extent permitted by law, our total aggregate liability for claims relating to the Service will not exceed the greater of:
- the amount you paid for the Service during the 12 months before the event giving rise to the claim; or
- CAD $100.
These limitations do not apply to liability that cannot be limited under applicable law, including any mandatory consumer-protection rights.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Apex Forge and its directors, officers, employees, contractors, and affiliates from third-party claims, losses, and reasonable costs arising from your unlawful use of the Service, your User Content, or your material violation of Sections 5 or 6. This obligation does not apply to the extent a claim results from Apex Forge's own negligence, wilful misconduct, or breach of these Terms.
16. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate access when we reasonably believe that you have materially violated these Terms, created a security or legal risk, abused cloud resources, committed purchase fraud, or failed to pay an amount due.
Where reasonable, we will provide notice and an opportunity to correct the issue. Immediate action may be taken when necessary to protect users, providers, rights holders, or the Service.
On termination, your right to use affected Service features ends. Provisions that by their nature should survive will survive, including provisions concerning ownership, accrued payments, disclaimers, liability, indemnity, and dispute terms. Store subscriptions continue until cancelled through the applicable store.
17. Governing Law and Disputes
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any mandatory consumer right to bring a claim elsewhere, the courts of British Columbia have exclusive jurisdiction over disputes arising from these Terms or the Service.
Before filing a formal claim, you and Apex Forge agree to make a good-faith effort to resolve the dispute by written notice. Send notices to info@apexforge.tech and include a description of the issue and the resolution requested.
Nothing in this section prevents either party from seeking urgent injunctive relief or using an eligible small-claims process.
18. Changes to These Terms
We may update these Terms for legal, security, technical, provider, or business reasons. We will update the “Last Updated” date and provide any additional notice required by law. If you do not agree to updated Terms, you must stop using the Service. Changes will not retroactively reduce rights relating to a completed purchase where prohibited by law.
19. General
If any provision is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, reorganization, financing, or sale of the relevant business, subject to applicable law.
These Terms, the Privacy Policy, the purchase terms shown at checkout, and any applicable store terms form the agreement concerning the Service. If store terms conflict with these Terms on payment processing, cancellation, or refunds, the mandatory store terms control for that purchase.
